Jim Baird, Angie Craig, James Comer, Gabe Evans, and Tim Moore are currently circulating new legislation that would replace the current industry-killing sunset with a 3-year extension; a sufficient timeline to implement a sensible solution that prioritizes safety while protecting American farmers, small businesses, and over 325,000 industry jobs.

The Baird-Craig legislation is bipartisan and practical, protecting both consumers and American jobs. It provides the necessary runway to establish real safeguards rather than rushing to prohibition, which would eliminate American businesses and push consumers toward dangerous alternatives, including unregulated illicit products, highly addictive opioids, and foreign supplies with less oversight than American-made products.

Congress has reopened the government, but hidden deep in that same bill was a dangerous amendment known as the McConnell–Harris Hemp Ban. This rushed provision threatens to wipe out over 325,000 American jobs, devastate small businesses, and destroy the livelihoods of thousands of U.S. farmers who helped build the hemp industry since its legalization in 2018.

If left in place, the ban will outlaw most hemp-derived products like Delta-8, Delta-9, THCA, HHC, and other cannabinoids including those currently available for sale at SMOKEA® — forcing consumers to turn to unregulated or foreign sources instead of safe, transparent American brands.

Congress has already shown that it can move quickly to correct mistakes in emergency legislation. Now, they must do the same for hemp. There is a one-year window before this ban takes full effect and we need to use that time to demand a fix and protect this American-grown industry.
